Eligibility

Medical Disclaimer

The Services are not a substitute for professional medical advice, diagnosis, or treatment. You are solely responsible for your use of the Services and assume all associated risks. Do not use the Services if you have a health condition that may pose a risk to your health, including but not limited to:

  • Excessive sweating
  • Swelling, discoloration, or bruising

Somatic Health does not provide medical advice. All content is for informational purposes only. Always consult your physician before beginning any exercise or health program. In case of an emergency, call 911 immediately.

User Guidelines

You agree not to:

  • Use the Services for any purpose other than personal, non-commercial use
  • Share, distribute, or disclose the Services to third parties (except your healthcare provider)
  • Share your user ID or transfer your account without written permission from Somatic Health
  • Access the Services through unauthorized means

Data Privacy, Storage, and HIPAA Compliance U.S. Data Storage

All U.S. patient data is securely stored in Amazon Web Services (AWS).

International Compliance:

Somatic Health does not process or store user or patient data outside the United States. If services expand globally, we will implement necessary audits and compliance measures to meet international regulations.

  • California residents are also entitled to privacy protections under the California Consumer Privacy Act (CCPA).

Intellectual Property Rights & Licenses

All content, trademarks, features, tools, and functionality provided through the Services are the exclusive property of Somatic Health. You may not:

  • Reproduce, distribute, publish, or commercially exploit any portion of the Services
  • Modify or create derivative works without our prior written consent
  • Use our trademarks without express written permission

Disclaimer of Warranties

The Services are provided "AS IS" and without warranty of any kind. Somatic Health disclaims all warranties, express or implied, including:

Limitation of Liability

If any limitation is found unenforceable, Somatic Health's total liability shall not exceed $100 USD.

Indemnification

  • Your negligence or misconduct

At our option, you will control the defense of any such claim, provided we retain the right to participate and approve any settlement.

Dispute Resolution & Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, U.S.A., without regard to its conflict of laws principles.

  • All disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association. You waive the right to a jury trial or to participate in a class action. This does not prevent either party from seeking injunctive or equitable relief for intellectual property or confidentiality breaches.

International Use

The Services are controlled and operated from the U.S. We do not guarantee the Services are appropriate or available in other locations. Users outside the U.S. do so at their own risk and must comply with local laws.

Right to Modify or Discontinue Services

We may modify or discontinue the Services (or any part thereof) at any time, with or without notice. We are not liable to you or any third party for such modifications.

Privacy

Use of the Services is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal data. By using the Services, you consent to our data practices.
